Prosecution Rests In Kalmio Trial | Video

Julie Leonardi | 2/1/2013

Day five of testimony began this morning for the Omar Kalmio murder trial. Kalmio is being charged with the murder of his ex-girlfriend, Sabrina Zephier, and her family; Jolene Zephier, Dillon Zephier, and Jeremy Longie who were found shot to death in their homes.

The trial began Monday and is now moving into the final phase.

Dave Goodman, Minot Police Sergeant, testified he spoke to Kalmio the day after the murders, and said Kalmio was emotionless about the death of the mother of his child.

Goodman was asked to go through the phone records between Sabrina Zephier and Kalmio. The night before the murders, Sabrina had called Kalmio 30 times, but he had only made one call, where he blocked his own number. His next call wasn’t made until the next afternoon.

After several hours of questioning Goodman, the prosecution rested their case.

The defense responded, asking Judge Doug Mattson to dismiss the case because lack of concrete evidence.

After a short recess, Judge Mattson denied that request, given the circumstantial evidence, and the testimonies from the week, Kalmio had the motive and the opportunity to commit the crime. This case will now rest with the jury.

Closing arguments will happen on Monday and jury will begin their deliberations shortly after.
