He then ordered the group to pay back some of the legal fees incurred and issue an apology to the defendants.
They are now asking the judge to reconsider.
"We have no idea what he could possibly be talking about other than a very aggressive effort to basically try to keep people from exercising their rights under the laws of the state of North Dakota," said Robert Hale with Empower the Taxpayer.
Hale says the next step, if the judge rules against them, is to take the issue to the state Supreme Court.
