Bail has been set at $25,000 for a man authorities say passed out on top of a two-month old girl he was babysitting and smothered her.
Authorities say Arthur Berger, a friend of the parents, was intoxicated at the time.
Her parents found that the child was not breathing when they returned from a night out on Saturday morning.
Attorneys say Berger`s bail is high because of the nature of the charges. If he gets out, he`ll be required to pass a daily alcohol test.
"The difference between the various homicides are negligent homicide, which is a lower offense as a c felony, versus manslaughter, which requires recklessness," says Reid Brady, the Cass County Prosecutor.
Berger`s attorney says he just received the case and hasn`t had a chance to review it.
